Supreme Court Update 09/05/2012

Dear Speak Asian,
Senior Counsel for EOW was not present ,Hon. Supreme Court asked income tax dept for tax liability of speak asia and asked income tax dept to close this matter as soon as possible now our matter will be…heard tomorrow on 10 may 2012.
This is a very positive sign for all of us.if eow does not come tomorrow then Hon.Supreme Court will order EOW to hand over the website because if respondent does not appear in supreme court for being several times called upon so don’t panic we all will hear very positive news tomorrow and in Hon.S.C. it is not easy to get date so soon.we have got it.

Is Media Confused???

Dear Viewers,

Sometime back the media reported based on input from the investigation agencies that SpeakAsia surveys are fake and they are being made in Mumbai. Below is extract from article of a leading newspaper, DNA India, published on 1st Oct 2011.

"The finding is based on an arrested web designer’s confession. According to EOW sources, Nayan Khandor, the director of Brand Saloon Inc in Dadar (W) and a web designer, met SpeakAsia CEO Manoj Sharma in February 2010. He was given the task of creating e-surveys and e-magazines for the firm.

“He told us that initially, he was paid Rs 10,000 a month.But his last cheque was for Rs 1.50 lakh. This means that he had increased his survey rates after SpeakAsia became popular and more people started investing in it,” said an EOW official on the condition of anonymity."

Now, today on 27th Feb 2012, another leading news paper Times of India has published another report, which says

"A source said Seven Rings entered into an agreement with SpeakAsia Pte ( Singapore) and Haren Ventures Pvt Ltd. "Seven Rings offered to act as a publisher for SpeakAsia surveys but on the condition that they get 60% profit while SpeakAsia got 40%. Seven Rings said it had a wider reach and the agreement would be beneficial to SpeakAsia. They promised to publish an electronic magazine (e-zine) too," said the source.

If Mr. Khandoor admitted that the surveys were made by him, after 5 months the same sources are telling that the surveys were taken care by Seven Rings International?? Is media confused?? Friends, this shows that Speakasia is being framed falsely and the investigations against the company has not proven anything till date. Media is helping only in negative way.

Company has deposited $10 million (about Rs.50 crores) in the supreme court registry and they are not going anywhere but forward. Lets be united!!

At the outset we would like to state that we welcome the verdict of honourable Supreme Court with regards to the WRIT PETITION (CIVIL) NO(s). 383 OF 2011. In our opinion this judgement only furthers our belief in the honourable courts protecting the rights of the consumers in the country.

As is the stated position of the company, SAOL will extend all the support required in executing this directive of the honourable Supreme Court and will actively work towards re-starting its suspended operations at earliest opportune moment.

This morning brought one of the greatest news of this year. Today in Supreme Court the SAOL management got its clear victory. The honorable Supreme Court has passed an order which is clear and exactly in the favor of the Company.

Following are some extract of the order of the honorable supreme court:

1. SAOL has been ordered to deposit Rupees 50 crores with the Supreme Court.

2. Central Board Of Direct Taxes (Income Tax Authority) has been asked to give the details of their dues from the Speak Aisa.

3. Economic Offence Wing(Mumbai Police) has been ordered to handover the admin rights of the website along with all other material to the Hon’ble Mr. Justice R. C. Lahoti.

  SAOL will deposit the total amount with Supreme court and panelists will be paid their dues through the channels monitored by supreme court.

The company was more than willing to pay and even offered that they can pay these amounts from Singapore bank directly, but the court did not agree and asked them to submit in India, on which the company readily agreed.

We always talked about company's intention and this is a victory of that intention. Things are moving in the direction which company always wanted to and the hearings now are result oriented.

SpeakAsia website not working

Dear viewers,

As you all know that the company's official website www.speakasiaonline.com is not getting opened. There is nothing to be worried about because as per our conversation with the officials of SAOL they have given the following explanation:

The reason behind this is, Company has purchased domain name www.speakasiaonline.com from www.godaddy.com. www.speakasiaonline.com domain name has been suspended due to invalid Whois(like Know Your Customer KYC norms followed by Banks) information. According to GoDaddy terms and conditions at least once in a year domain owner has to verify or update whois information, i.e; Company Name, Address, Contact No. , other details etc.

As per the company officials SpeakAsiaOnline Management will contact GoDaddy to rectify this problem. This issue is temporary and is not going to hamper the overall fight by the SAOL and its 20 Lakh strong Speak Asian community.

Supreme Court's direction to RBI in Speak Asia case

Dear viewers,

Please go through the order page of the Supreme Court given on 16th Jan, 2012 in SAOL matter in this article. In this order the apex court has ordered the Reserve Bank of India to file an affidavit within a period of two weeks. And now the hearing is listed on 6th Feb, 2012. We would like to draw your attention to an E mail communication dated 14th December, 2011, in which RBI has written to the company saying that the RBI has not placed any restrictions on the company bringing in money through proper banking channels, Further RBI has not placed any restrictions to pay any money to the panelists in accordance to law.

With this clarification from the RBI the way is cleared for the company to bring in the money for the panelists and is now only dependent on getting the requisite clearance from the Supreme Court. From this email communication we can be confident that the RBI's report to SC will definitely be positive. And once the RBI files an affidavit, and the SC gives an order based upon it, then the way will be clear for SAOL to distribute the money to the panelist and probably restart the business once again in full fledged manner.

Speak Asia's supreme court hearing on 09/01/2012

Dear BizBasket viewers,

Following are the latest updates on Speak Asia:

1. Today all the concerned parties to the case like RBI, EOW, CBDT, SAOL and others were been represented by their lawyers in court room. This was the major happening in the court room today where each and every party was present.

2. These Parties said to the court that they are unaware of the content of the mediation report submitted by Honorable Justice R. C. Lahoti to the Supreme Court, hence its difficult for them to give any decisions as they have not read the report yet.

3. Honorable Judges of Supreme Court has given orders to provide mediation report to all the Parties as soon as possible.

4. Now next hearing is fixed on Next Monday i.e. 16th Jan, 2012.

5. In the meanwhile the speakasiaonline.com website is back and operational once again. But as per the officials of SAOL the site is still with the EOW and has not been given back to Speak Asia management. The RPs which has got credited on 5th January, 2012 in your respective E-Vallets is the result of an automated process in the website and any operation has not been performed on the website from the SAOL technical team yet.

Friends ! the time to celebrate has not come yet. So there is nothing to get very excited. We need to wait for next Supreme Court hearing on 16th January, 2012. But from our continuous interactions with various authentic resources, Lawyers and SAOL officials one fact we can assure you all that our victory is not too far and we are surely going to see the business of Speak Asia getting normalized very soon. At this last phase of battle lets not get panic and wait for the next Supreme Court hearing.
